Taking the first step! Will vaping be legal in Brazil with more than 2 million users?


Starting from December 12, 2023, Brazil has officially launched the legal public consultation process for vaping, which will last for 2 months and is expected to be until February 9, 2024.


According to Brazilian media Poder 360, the Brazilian National Health Supervision Agency (Anvisa) has launched a public consultation on the use of e-cigarettes in Brazil on December 12, local time.

 

The consultation will last for 60 days and everyone has the right to participate. In these overseas countries, public consultation (PC) is a decision support mechanism. The agency banned the use of vaping in Brazil in 2009. Now, according to Antonio Barra Torres, president of Brazil's National Health Surveillance Agency, when the public consultation was announced in October 2023, the topic will be re-evaluated after collecting all opinions.

 

According to reports, local Brazilian people support the standardized management of e-cigarettes rather than a total ban.

 

For example, Brazilian psychiatrist Jorge Costa e Silva, a former director of the World Health Organization (WHO), supports the standardized management of vaping. He believed that all prohibited things were bad and opposed total bans. His point is that what many people don't understand is that standardized management and a total ban are two different things.

 

Gonzalo Vecina, a professor at the School of Public Health at the University of São Paulo and former president of Brazil's National Health Supervision Agency, also supports the standardized management of e-atomization. He also notes that the nicotine in e-cigarettes is harmful to health, but believes these devices are less harmful than traditional cigarettes. Since traditional cigarettes are now allowed, he believes e-cigarettes should also be allowed to be consumed.

 

In October this year, Brazilian Senator Soraya Thronicke once said, "What is more dangerous than regulation is lack of regulation. We cannot allow the sales of electronic cigarettes (vapes) in Brazil to proceed unconditionally on the black market."

 

Now, the Brazilian Health Supervision Bureau is about to review the issue of vaping. The senator's proposal to regulate the market and conduct public consultation is already a major and critical first step and deserves attention.
