The South Dakota House of Representatives passed Bill 1069 to regulate the sale of e-cigarettes. The act requires merchants to obtain a distribution license, which each store requires to apply for separately, and distributors to be certified as manufacturers.
According to KOTATV on February 11, the South Dakota House of Representatives passed Bill 1069 by a vote of 57-11, which seeks to regulate the sale of e-cigarettes in the state. The bill stipulates that businesses selling electronic cigarettes need to obtain a distribution license for electronic cigarette products, and each sales place needs to apply separately; In addition, distributors need to be certified by the manufacturer of e-cigarettes before they can sell them. The law has sparked controversy in local smoke shops.
Broderick Harrington, manager of Smoke Solutions in Rapid City, South Dakota, said the bill makes sense if it is aimed at ensuring distributors' credentials and compliance. But if it is to make transactions between retailers and distributors more difficult, it is a waste of time. He believes that it is necessary to ensure the qualifications of distributors to prevent them from engaging in illegal business.
The bill now goes to the South Dakota Senate for consideration.
