The Country Has Issued A New Decree: A Complete Ban On Oral Nicotine Products Will Come Into Effect Officially After Six Months.

On September 5, 2025, the French government issued Decree No. 2025-898, announcing a ban on the production, import, sale and use of mouth-containing nicotine products throughout the country. The ban will come into effect six months after the decree is issued and will apply to manufacturers, importers, distributors, retailers and consumers.
According to the relevant provisions of the Public Health Code, nicotine is classified as a "toxic substance" due to its harmful effects on human health. This ban covers various forms of mouth-containing nicotine products, including: nicotine pouches (portion/sachets), chewing gum, lozenges, strips; nicotine paste, granules, liquids, etc.; and any combination of the above forms.
Exemption scope:
The ban does not apply to: traditional chewing tobacco; products that meet the definition of medicine or medical device; natural nicotine-containing food, or agricultural products that comply with EU pesticide standards.
In addition, for research purposes, an exception permit can be obtained with the approval of the French Minister of Health and the Minister of Research. This decree also applies to the French overseas territory of Wallis and Futuna Islands. This legislation demonstrates France's tough stance in the public health field, aiming to prevent nicotine from entering the market in the form of new mouth-containing products and further tightening the regulation of nicotine other than tobacco and electronic cigarettes.
