In July 2024, the Department of Trade and Industry (DTI) of the Philippines suspended the online sales of e-cigarettes and new tobacco products. Recently, the department issued new regulations, re-permitting online sales but imposing new restrictions and requirements.
On April 15, 2025, the Department of Trade and Industry of the Philippines officially promulgated Departmental Executive Order No. 24-05, allowing the sale and distribution of e-cigarettes and new tobacco products through online platforms, provided that the online platforms ensure that minors are denied access, and consumers must undergo identity verification and registration on the platform before they can make online purchases.
The main contents of this regulation include:
Mandatory age verification: Online platforms are required to use technologies such as ID document verification, biometric recognition, and artificial intelligence to block access by minors; User registration threshold: Consumers must submit a photo of their ID card and sign a commitment letter; Compliance qualification review: Only registered merchants are allowed to sell products that comply with health warnings and tax standards; Dynamic supervision mechanism: The Department of Trade and Industry of the Philippines conducts regular inspections and has the right to directly remove illegal products; Data privacy protection: Age verification must comply with privacy regulations to prevent information abuse. Effective date: Effective immediately.
