First case in Sanya, Hainan: Criminals were sentenced and fined for selling counterfeit e-cigarettes
On September 27th, the Chengjiao People's Court in Sanya City sentenced Wu to one year in prison and a fine of 50,000 yuan for selling counterfeit electronic cigarettes, marking the first such case in Sanya.
In May 2023, Wu, who did not have a license, sold electronic cigarette cartridges to Guo for a total of 60,200 yuan. After inspection, the seized electronic cigarette cartridges were found to be counterfeit. On September 15th, the Chengjiao People's Procuratorate filed a public prosecution against Wu for selling counterfeit products.
Since May 1st, 2022, the "Electronic Cigarette Management Measures" have been formally implemented, which clearly stipulate that electronic cigarette products must comply with compulsory national standards for electronic cigarettes. Those engaged in electronic cigarette retail business should apply for tobacco retail licenses from tobacco monopoly administrative authorities in accordance with the law. The sale of flavored electronic cigarettes other than tobacco flavor and electronic cigarettes with self-addable aerosols is prohibited.
On October 1st, 2022, the "Compulsory National Standard for Electronic Cigarettes" was officially implemented, imposing strict regulations on the production of electronic cigarette devices, aerosols, and more. Only electronic cigarettes produced in accordance with the national standard can be sold.
Prosecutors reminded everyone that according to Article 140 of the Criminal Law, producing and selling counterfeit tobacco products with sales over 50,000 yuan constitutes the crime of producing and selling counterfeit products. Therefore, selling counterfeit electronic cigarettes will also be held criminally responsible for producing and selling counterfeit products.
