Canadian tobacco lawsuit reaches record settlement agreement, with three major companies including Philip Morris International agreeing to pay $23.6 billion in compensation

Philip Morris International, British American Tobacco, and Japan Tobacco have agreed to pay $23.6 billion to resolve Canada's long-standing tobacco lawsuit. Philip Morris International stated that the plaintiff (smoker) will decide whether to accept the plan in December 2024, and if accepted, judicial approval will take place in the first half of next year.

 

According to a recent report by Reuters, Philip Morris (hereinafter referred to as "Philip Morris International"), British American Tobacco, and Japan Tobacco have agreed to pay CAD 32.5 billion (USD 23.6 billion) to resolve Canada's long-standing tobacco lawsuit, as part of a plan proposed by a court appointed mediator.

 

Jacob Shelley, co director of the Ethics, Law, and Health Policy Laboratory at the University of Western Canada, said that if the plan is accepted, it will be the largest settlement agreement of its kind outside the United States.

 

It is reported that in 2015, subsidiaries of Canada's three major tobacco companies suffered heavy losses in Quebec. A court ruled that it should compensate approximately 100000 smokers or former smokers for claiming that the company knew its products could cause cancer and other diseases as early as the 1950s, but did not warn consumers.

 

After the appeal, the Quebec court upheld the 2015 ruling, requiring smokers to receive compensation of over 15.5 billion Canadian dollars. This has forced subsidiaries of the three major tobacco manufacturers to seek bankruptcy protection. British American Tobacco Company in Canada is required to pay the maximum compensation amount of CAD 10.5 billion. Philip Morris needs to pay CAD 3.1 billion, while Japan Tobacco's compensation amount is CAD 2 billion. The case is expected to be brought to the Supreme Court of Canada.

 

Afterwards, the three companies entered into a court supervised mediation process to discuss possible settlement agreements. According to reports, the allocation of the total amount of the agreement has not yet been resolved.

 

Although some important issues in the plan still need to be resolved, we hope that this legal process can be concluded soon, allowing RBH (Rotemans, Binchen, and Hergis) and stakeholders to focus on the future, "said Jacek Olachak, CEO of Fimo International, on Friday. Rotmans, Binchen, and Hergis are Canadian subsidiaries of Philip Morris International.

 

On Friday, British American Tobacco stated that the proposed plan marks a step towards finding a solution. The company did not provide plan details like Philip Morris International did. The company stated that its subsidiary, Canadian Imperial Tobacco, supports the framework and structure of the program, and the settlement will be funded by existing funds and future sales of tobacco products in Canada.

 

Philip Morris International stated that the plaintiff (smoker) will decide whether to accept the plan in December 2024, and if accepted, judicial approval will take place in the first half of next year. JTI Macdonald, a subsidiary of Japan Tobacco, stated that "certain key issues must be addressed if feasible solutions are to be found," but did not provide further details.

 

Jacob Shirley from the University of Western Canada believes that the settlement agreement missed the opportunity to include company policy provisions, but emphasized the manufacturer's responsibility to warn consumers about the risks of their products. This may have an impact on industries such as alcohol. He added, "We haven't given sufficient warnings about the risks of many products. Manufacturers have a responsibility to remind us of these risks... I hope this can change manufacturers' perception of potential liability
