Arkansas Has Become The 12th State in The United States To Enact An Electronic Cigarette Registration Law.

On April 14th, the Governor of Arkansas signed Senate Bill No. 252 (SB252) into effect, which was subsequently numbered as Act No. 590 (Act 590). As a result, Arkansas became the 12th state in the United States to pass the Electronic Cigarette Product Registration Law.
This law established a list of electronic cigarette products that could be legally sold in Arkansas. Electronic cigarette manufacturers must apply to have their products included in the list, pay a fee for each product or each series, and ensure that each submitted product meets the requirements for inclusion in the list. Otherwise, they will be subject to perjury penalties. Similar to other states that have implemented electronic cigarette registration laws, the requirements for including products in the Arkansas list are as follows:
The product must have entered the US market before August 8, 2016 (Note: This clause will exclude most illegal disposable electronic cigarettes currently on sale). The manufacturer must submit a pre-market application (PMTA) for tobacco products to the FDA before September 8, 2020. The product must meet any of the following conditions: have received marketing authorization from the FDA; or be under FDA review; or although a marketing rejection order from the FDA has been received, the ban has been suspended by a federal court or the FDA.
Electronic cigarette products must be declared by September 1, 2025, so as to be included in the list. Products not included in the list will be prohibited from sale after that date. The list will be published by the Arkansas Director of Tobacco Control on November 1 or later, and will then be implemented. If retailers, wholesalers, and manufacturers violate this law, they may face legal penalties, including fines and confiscation of products. The Arkansas Director of Tobacco Control has the authority to conduct business premises inspections, gather evidence, and prosecute offenders.
This law also prohibits individuals from possessing and importing non-compliant products. After Louisiana, Arkansas is the second state to prohibit individuals from possessing illegal electronic cigarettes.

Latest progress of electronic cigarette registration laws in US states:
Five states that have already passed electronic cigarette registration laws: Alabama, Florida, Kentucky, Louisiana, and Oklahoma.
Five additional states will come into effect in 2025: North Carolina (May 1), Virginia (July 1), Wisconsin (July 1), Arkansas (November 1), and Mississippi (December 1).
The legislative processes of Utah and Iowa have been put on hold and are awaiting the outcome of lawsuits.
At present, more than 20 states in the United States are considering relevant legislation. The electronic cigarette registration bills in Georgia, South Carolina, Tennessee and Texas have entered the legislative process.
