Regulation upgrade: "Tobacco products" have been included in the 801(a) import review clause. 801(a) is the core clause for FDA's right to refuse imports. After the amendment: E-cigarettes and ENDS can be directly refused entry as "tobacco products". This further exacerbates the export risks for China's supply chain.
