The Brazilian health department has comprehensively strengthened the ban on e-cigarettes, including prohibiting commercialization, import, storage, advertising, and banning their use in public environments, urging businesses to comply with regulations and ensure public health.
According to a report by the Brazilian media "Public Information" on May 23, the Brazilian health department has strengthened the ban on e-cigarettes. Brazil's National Health Surveillance Agency (Anvisa) has tightened its ban on electronic smoking devices (DEFs) including the popular e-cigarette. According to Joint Board Resolution No. 855/2024, the commercialization, import, storage, transportation, and advertising of such equipment are prohibited. Additionally, use in public or private enclosed environments remains prohibited.
The Secretariat for Consumer Protection and Defense will step up supervision to ensure the implementation of the new resolution, especially in places such as tobacco shops. The head of the secretariat, lawyer Júlia Holst, stressed that traders need to pay attention to Anvisa's new regulations. She also pointed out that the supervisory authority of the municipality of Procon Macaé (Macaé) will actively monitor and sanction the illegal sale of these products and punish them in accordance with the regulations of the National Consumer Secretariat (Senacon).
The ban also extends to a ban on advertising of smoking products in any media, whether paper, electronic or digital. Merchants who violate the rules will receive notices requiring them to remove illegal advertisements. This regulation, which has been implemented since 2009, is reconfirmed by the new resolution.
Anvisa's decision is an important step to protect public health and underscores the importance of strict measures to combat e-cigarette use and marketing.
