Poland's Ministry of Health proposes to ban the sale of nicotine pouches online and in multiple offline locations

The Polish Ministry of Health plans to ban the sale of all types of e-cigarettes and nicotine bags to minors, and to ban the sale of nicotine bags in some places and online. The bill plans to set a six-month transition period, and the revised bill will take effect 14 days after the announcement.

According to Bankier on January 14, the Polish Ministry of Health proposed a bill that plans to ban the sale of all types of e-cigarettes to people under the age of 18, and prohibit the use of e-cigarette products, including nicotine-free e-cigarettes, in places such as schools and children's playgrounds.

The bill proposes to amend the Health Protection Act to prevent the negative effects of the use of tobacco and its products. Specific contents include prohibiting the sale of any type of e-cigarettes and spare e-liquids to minors, regardless of whether these products contain nicotine.

In addition, the bill plans to revise the definition of "smoking e-cigarettes" and characterize the use of nicotine-free e-cigarettes in public places (such as schools, kindergartens, public transportation stations and children's playgrounds) as illegal. These places currently prohibit the use of nicotine-containing e-cigarettes.

The draft also proposes to ban the sale of nicotine pouches to minors, and prohibit the sale of such products in medical institutions, schools, educational training institutions, sports and entertainment facilities, as well as vending machines and self-service systems. The bill also prohibits the sale of nicotine pouches online, which is similar to the regulations on the sale of smokeless tobacco products.

The bill plans to set a six-month transition period, and the revised bill will take effect 14 days after the announcement.

According to the website of the Polish Government Legislative Center, the government will also review another proposal put forward by the Ministry of Health.
