The US FDA has issued warnings to nine online retailers and one manufacturer, accusing them of selling unauthorized electronic cigarettes. These products attract young people with their "smart" design, featuring functions such as playing games, connecting to mobile phones, and receiving text messages, aiming to conceal the true nature of their tobacco products.
On October 30th, the US Food and Drug Administration (FDA) announced that it has issued warning letters to nine online retailers and one manufacturer, accusing them of selling and/or distributing unauthorized disposable electronic cigarettes that are designed and function similarly to smart technology, including smartphones and gaming devices.
The product mentioned in the warning letter is advertised as having multiple designs and features that may appeal to young people, such as being able to play games, connect to smartphones, receive SMS or phone notifications, play music, or personalize the product with custom wallpapers.
These products may look like smart devices, but in reality they are not smart at all, "said Dr. Brian King, Director of the FDA Tobacco Products Center and a Master of Public Health. They are sold illegally and are a blatant attempt to target children
In addition, the unauthorized product designs mentioned in the warning letter may attract young people as they help conceal the nature of the product as a tobacco product from parents, teachers, or other adults. The companies that received these warning letters sell and/or distribute electronic cigarettes in the United States, but these electronic cigarettes are not authorized by the FDA to legally sell new products, violating the Federal Food, Drug, and Cosmetic Act. In addition to the violations mentioned in the warning letter, retailers and manufacturers are also warned to address any violations that are the same or similar to those described in the warning letter and take any necessary measures in a timely manner to comply with the law. Failure to promptly correct violations may result in FDA taking other actions, such as injunctions, seizures, and/or civil fines.
The FDA remains steadfast in enforcing the law, "said John Verbeten, Director of the CTP Compliance and Enforcement Office. We will continue to take appropriate measures and work together with our federal law enforcement partners to address unauthorized tobacco products, especially those that appeal most to young people
The latest round of warning letters marks another step in the FDA's continued efforts to remove unauthorized e-cigarette products, especially those that appeal to young people, from the market. So far, the FDA has issued over 700 warning letters to companies manufacturing, selling, and/or distributing unauthorized new tobacco products, over 690 warning letters to retailers selling unauthorized tobacco products, and filed civil penalty complaints against over 75 manufacturers and over 150 retailers, accusing them of distributing and/or selling unauthorized tobacco products.
As of October 30, 2024, the FDA has approved 34 electronic cigarette products and devices. The agency maintains a printable single page flyer that lists all authorized e-cigarette products, which retailers can review to determine which products can be legally marketed and sold in the United States. Entities that manufacture, import, sell, or distribute electronic cigarettes without necessary pre-market authorization will face enforcement risks.
