Are vapes illegal in Mexico

According to the current laws of Mexico, electronic cigarettes have been completely banned on a commercial level, but personal possession and consumption themselves are not illegal. This ban officially came into effect on January 16, 2026, and is the most stringent regulatory measure for electronic cigarette products in Mexico.

⚖️ Core legal framework: Complete commercial ban
Mexico revised the General Health Law to include electronic cigarettes under strict regulation. The specific provisions are as follows:

Prohibited activities: The law prohibits almost all commercial activities related to electronic cigarettes, including production, manufacturing, mixing, packaging, storage, transportation, import, export, distribution, sale, and supply. Any form of advertising, promotion, or sponsorship is also completely prohibited.

Legal classification: During legislative discussions, electronic cigarettes were classified as products with the same legal status as narcotics and psychotropic substances. This reflects the Mexican government's stance that it considers them a major public health threat.

Personal possession and consumption: The only exception
There is a key exception in the law: Personal possession and consumption for non-commercial purposes are exempted.

This means that if you personally possess electronic cigarettes for your own use and there is no evidence that you intend to sell or distribute them, then this behavior itself does not constitute a crime. This is fundamentally different from selling or producing electronic cigarettes.

⚠️ Legal consequences: Severe criminal penalties
The penalties for violating the commercial ban are very severe, aiming to completely eradicate the legal market for electronic cigarettes:

Imprisonment: A prison sentence of 1 to 8 years can be imposed.

Fines: The fine amount can be up to 234,620 Mexican pesos (approximately 12,000 to 12,500 US dollars). The fine amount is usually calculated in Mexican "units of measurement and update" (UMA), and can be up to 2,000 times the UMA.

Other measures: Health authorities have the right to confiscate products and close non-compliant business premises. All relevant health licenses previously granted also automatically become invalid.

 Legislative background and current situation
This ban is part of the health reform promoted by President Claudia Sheinbaum's government, with one of its goals being to curb the prevalence of electronic cigarettes among teenagers.

Although the law has come into effect, it is reported that electronic cigarettes can still be purchased in some retail stores in Mexico City, indicating that the enforcement process may face challenges. Additionally, some analyses suggest that the ban may lead to organized crime groups further controlling the black market for electronic cigarettes.

In summary, in Mexico, selling, producing, or distributing electronic cigarettes are serious criminal offenses, but personal use is in a legal gray area and is not considered a crime.
