The U.S. International Trade Commission (USITC) decided not to review the Chief Administrative Judge's ruling and extend the completion date of the "337" investigation of disposable e-cigarette devices to September 2025 to avoid conflicts with other investigation schedules.


On August 29, the U.S. International Trade Commission (USITC) announced its decision not to review the preliminary ruling (Order No. 37) issued by the Chief Administrative Judge (CALJ) on July 31, 2024, which extended the target completion date of the investigation to September 29, 2025.

 

The U.S. International Trade Commission (USITC) decided not to review the preliminary ruling (Order No. 37) issued by the Chief Administrative Judge (CALJ) on July 31, 2024, which extended the target completion date of the current investigation to September 29, 2025 based on Section 337 of the Tariff Act of 1930 (19 U.S.C. 1337) and the Commission's rules (19 CFR Part 210). The purpose of this extension is to avoid conflicts with other investigations, so the results of the investigation will not be finalized before May 29, 2025.

 

The investigation stems from a complaint filed by R.J. Reynolds Tobacco Company and R.J. Reynolds Vapor Company on December 15, 2023, alleging that certain disposable electronic cigarette devices and their components and packaging violated Section 337 of the Tariff Act of 1930 due to false advertising, false origin markings and unfair competition, and seriously damaged the domestic industry of the United States. As many as 25 companies were investigated, covering tobacco and electronic cigarette related companies in the United States, Shenzhen and other regions. Subsequently, on June 13, 2024, the Commission approved the addition of four companies as subjects of investigation.

 

The Commission's final ruling will be announced before September 29, 2025, and the results of the investigation may have a far-reaching impact on related markets and companies.
