US FDA cracks down on ZYN nicotine bags, sends 119 warning letters to retailers
Recently, the FDA announced that it has issued 119 warning letters and filed 41 civil penalty complaints to physical retailers involved in the sale of ZYN nicotine bags of various flavors to minors between October 2023 and February 2024.
On April 4, the FDA announced that it had issued 119 warning letters and filed 41 civil penalty complaints to physical retailers involved in the sale of ZYN nicotine bags of various flavors to minors between October 2023 and February 2024. Warning letters were also sent to three online retailers for selling unauthorized flavored ZYN nicotine pouches.
Data from the 2023 U.S. Youth Tobacco Survey shows that approximately 1.5% of teenagers currently use nicotine pouches. The FDA has received reports that these products may be increasingly popular among young people, and these products are also popular topics among young people on social media.
"While current data do not show an increase in youth use of nicotine pouches, the FDA remains concerned about any tobacco products that may appeal to youth, and we will continue to closely monitor youth use of these products," said Brian King, Ph.D., director of the FDA's Center for Tobacco Products. "There is no excuse for selling tobacco products to minors, and the FDA will hold retailers accountable for these violations, especially those who continue to do so despite being warned."
The FDA also said it is illegal for retailers to sell any tobacco product, including cigarettes, e-cigarettes, cigars and nicotine pouches, to anyone under the age of 21. This federal minimum selling age applies to all retail establishments and individuals without exception. In order for new tobacco products to be sold legally in the United States, they must obtain authorization from the FDA. To obtain authorization from the FDA, a product application must be submitted that includes sufficient scientific evidence that the product meets the necessary public health standards required by law. To date, the FDA has approved four oral tobacco products that meet the necessary standards. As of April 2024, the FDA has not authorized any ZYN products for sale in the United States.
The FDA typically sends a warning letter when a first investigation or inspection uncovers a violation. To achieve voluntary compliance, warning letter recipients have 15 business days to respond and describe the steps they will take to correct and prevent future violations. Failure to promptly correct violations may result in additional FDA action, including civil monetary penalties.
The FDA has announced 41 civil penalty complaints against minors for sales totaling more than $55,000. To date, the FDA has issued more than 550 warning letters and filed more than 100 civil penalty complaints to retailers selling unauthorized tobacco products. The FDA said it will continue to actively monitor the market and enforce the law, including through surveillance, inspections and investigations.
