The Philippines will implement new electronic cigarette product standard licensing regulations from June 5, 2024, and those who do not hold a standard license will not be able to enter the market. The Philippine Bureau of Standards announced that Venture Technocom System and Shenzhen Adwell Technology Co., Ltd. are the first companies to obtain certification.
According to Manila Standard on June 4, the Philippine Bureau of Standards (DTI-BPS), an agency of the Department of Trade and Industry (DTI), has issued the first batch of Philippine Standard (PS) licenses to heated tobacco manufacturers.
Amanda Nograles, Deputy Secretary of the Consumer Protection Group of the Department of Trade and Industry, said,
"Starting from June 5, 2024, any electronic cigarette product that does not carry the product standard [PS] mark or license or ICC mark will not be able to enter the Philippine market."
The companies that obtained the PS license this time include Technocom System Sdn. Bhd. and Shenzhen Adwell Technology Co., Ltd. (Adwell Technology), which successfully passed the rigorous review process and complied with the technical provisions of Republic Act No. 11900 of the Philippines, namely the Electronic Nicotine and Non-Nicotine Products Administration Act.
According to the list of certified products on the DTI-BPS website, Venture Technocom System and Shenzhen Aidiwell Technology Co., Ltd., manufacturers of IQOS ILUMA heated tobacco devices, have both obtained licenses valid for three years and need to be renewed six months before expiration. It is worth noting that Venture Technocom System and Aidiwell Technology are the only two factories that have obtained the PS mark license for any product under the "E-cigarette Law". PMFTC Inc. and Royal Connections Inc. are authorized importers of IQOS ILUMA devices.
In addition, Nograles revealed that "in January 2025, the Department of Trade and Industry will conduct market spot checks on e-cigarette products without PS or ICC marks. Sellers have at least six months to deal with their inventory."
DTI-BPS made it clear in an October 2022 public presentation that the certification work is to ensure that all products, devices and systems are strictly analyzed to meet quality standards and prevent illegal trade.
DTI has announced that all heated tobacco and e-cigarette products must be certified starting June 5, 2024. Distributors and retailers can continue to sell non-certified electronic nicotine and non-nicotine products until January 5, 2025. After that, only products with a valid PS mark or ICC label can be sold. For merchants who do not comply with the regulations, the Ministry of Trade and Industry has the right to issue an immediate recall, ban or seizure order to prevent their products from being sold or distributed in the public market.
According to Tianyancha, Shenzhen Aidiwell Technology Co., Ltd., established in 2019 and located in Shenzhen, Guangdong Province, is an enterprise mainly engaged in other service industries. The legal representative is Zhang Zehong, and the registered capital of the enterprise is 1 million yuan. The business scope includes: research and development, technical consulting and sales of electronic atomization equipment, electronic atomizers and their components and related equipment. In addition, according to the information, Aidiwell registered the SHFT trademark on March 19, 2024 and is currently awaiting substantive review.
