Knoxville, Tennessee - The Tennessee House of Representatives is expected to debate a bill on Wednesday, which aims to impose taxes on e-cigarette products and establish a registry of e-cigarette products approved by the Federal Drug Administration.
HB 0968 will impose a tax of $0.07 per milliliter on disposable e-cigarettes and 10% on refillable e-cigarette products, and create a new product registry covering all types of e-cigarette products sold in the state. Starting from January 1st, 2026, the state will be required to make the registry public and prohibit the sale of any products not listed in the registry.
This bill will prohibit products that have not been authorized by the FDA or are awaiting FDA authorization. From August 1st, 2025, and every year thereafter, e-cigarette product manufacturers must present proof of FDA approval or FDA review to the tax department.
Senators Ken Yager (R-Kingston) and Representative David Hock (R-Greeneville) proposed companion bills, stating that these bills will help prevent teenagers from accessing e-cigarettes and prohibit e-cigarette devices not approved by the Food and Drug Administration from entering the market.
According to the fiscal explanation of this bill, the new tax could bring in more than $16 million in revenue.
The Senate has passed the version of this bill by a vote of 24 in favor and 4 against.
The House may take action on this bill at the meeting on Wednesday morning at 11:30 Eastern Time. If the bill is passed, it will be submitted to the governor for final approval.
