Electronic Cigarette Regulations in Hong Kong Are Being Further Tightened! Starting From The Middle Of 2026, The Use Of Cartridges in Public Places Will Be Prohibited.

Recently, the electronic cigarette control policy in Hong Kong, China has undergone a major adjustment. On February 9th, the Hong Kong health department announced that it plans to ban the possession and use of electronic cigarette cartridges/canisters in public places starting from mid-2026. The relevant proposal is expected to be submitted to the Legislative Council for review in April, and the control of electronic cigarettes in Hong Kong has entered a comprehensive tightening stage.
This new regulation is an important supplement to the existing smoking control policies in Hong Kong. Since April 2022, Hong Kong has explicitly prohibited the import, production, and sale of electronic cigarettes and heated tobacco products. For violations related to imports, the maximum penalty is a fine of 2 million Hong Kong dollars and up to 7 years in prison. For production and sales violations, a maximum of 6 months in prison will be imposed. However, the previous regulations did not cover the personal possession and use aspects, which has allowed electronic cigarettes to still have a certain circulation space in the Hong Kong market.
According to official disclosure, this new ban will adopt a regional implementation strategy, being implemented first in outdoor public places, allowing citizens a transition period, and then gradually expanding to indoor areas. The core reason for this intensified control is that the cartridges and cartridges compartments of electronic cigarettes have become an important tool for "entertainment drug use". Recently, the Hong Kong authorities are focusing on cracking down on the abuse of propofol (commonly known as "space oil") through electronic cigarettes. This ban is also aimed at cutting off the transmission channels of related prohibited substances at the source.
In addition to the control of electronic cigarette cartridges, Hong Kong will also simultaneously implement phased restrictions on the sale of flavored tobacco. The Secretary for Health and Welfare of Hong Kong, Lu Chongmao, stated that the bill will include a ban on the sale of flavored tobacco. Given that about 40% of smokers in Hong Kong use flavored tobacco, these products significantly increase the appeal of smoking, especially easily inducing teenagers to try. Therefore, the control will be implemented in stages, with the first stage being the prohibition of non-menthol flavored tobacco, aiming to reduce the temptation of tobacco products at the source.
From the ban on import and sale in 2022 to the proposed ban on public place use in 2026, the control of electronic cigarettes in Hong Kong is forming a "full-chain supervision" system. The implementation of this new regulation is not only an important measure for Hong Kong to respond to the global smoking control trend, but also provides a new reference direction for regional smoking control. After the relevant proposals are submitted to the Legislative Council, they will enter the review process, and the final implementation details still need to be further announced.
