The Senate Of Uzbekistan Has Passed A New Law: Completely Banning Electronic Cigarettes.

According to Gazeta's report on April 30, the Senate of the Parliament of the Republic of Uzbekistan approved a law at a plenary session held on the same day. This law modified some of the existing laws and aimed to strengthen the requirements for the circulation of certain types of tobacco products, tobacco, and nicotine-using devices.
In recent years, the illegal import and circulation of new types of tobacco and nicotine products have increased, especially electronic cigarettes and e-liquids, leading to an increase in the user population, especially among children and young people.
Over the past four years, our country imported 5.4 million electronic cigarettes from abroad, worth 28.5 million US dollars, an increase of 80 times compared to previous years.
This law consists of 6 articles and modifies and supplements the "Criminal Law", "Administrative Liability Law", and "Restriction on the Distribution and Consumption of Alcohol and Tobacco Products Law".

This document stipulates that the circulation (production, manufacturing, storage, transportation or carriage, import and export from within Uzbekistan) of electronic nicotine delivery systems, including electronic cigarettes (vapes) and their liquids, is prohibited. As mentioned earlier, we are referring to electronic cigarettes, not tobacco heating systems (Iqos, glo, Ploom).
The difference between nicotine delivery devices (steam cigarettes, electronic cigarettes) and heated tobacco products (HTP) lies in their operating principles and the substances used. The former is an electronic device that vaporizes a liquid containing nicotine (sometimes with flavorings, glycerin, propylene glycol, etc.). The tobacco heating system is a device that heats tobacco without burning it (different from ordinary cigarettes) to release nicotine-containing aerosols.

 

Tobacco and nicotine products with evaporators in box-shaped electronic cigarettes/electronic cigarette modules - which require an evaporation device filled with nicotine liquid; bottles containing electronic cigarette liquid - containing nicotine and flavoring agents, used to fill electronic cigarettes; electronic pipe - a device in a style similar to a classic pipe, but equipped with an electronic evaporation system; JUUL and similar cartridge devices are a cartridge system that delivers nicotine into the body; disposable electronic cigarettes can be used immediately without refilling, and have multiple flavors; Pod-system - a miniature device with refillable capsules. Nicotine pad (nicotine package), without tobacco, but filled with nicotine. Snuff is crushed moist tobacco.
The accountability provisions also stipulate that illegal introduction of smokeless tobacco products and nicotine consumption devices (including electronic cigarettes) into circulation shall be held accountable for the offense.
Specifically, administrative liability stipulates confiscation of criminal items and a fine of 375 million to 750 million soms. Criminal liability (in cases of repeated violations after receiving administrative penalties) - a fine of 150 million to 225 million soms, or a maximum of 3 years of labor reform, or a maximum of 5 years in prison. Severe cases (large-scale or particularly large-scale, multiple offenses, committed by a group, using official status or protection) - a maximum of 12 years in prison.
The law stipulates that voluntarily surrendering to the authorities and handing over prohibited circulation products can exempt from liability.
