2ONE wins preliminary injunction, Imperial Tobacco's ZONE nicotine pouches may be restricted in the US

2ONE Labs, a US nicotine pouch brand, claims to have obtained a preliminary injunction in a trademark dispute with Imperial Tobacco ZONE, with the judge ruling that ZONE is prohibited from shipping to US trading partners.
On December 23, 2ONE Labs, a US nicotine pouch brand, announced on its official website that the brand and its distributor Performance Plus Marketing had obtained a favorable preliminary injunction (PI) ruling in a trademark dispute with Imperial Tobacco brand ZONE. According to the court order on December 20, 2024, ZONE nicotine pouches may not be shipped to US trading partners.
Vincent Schuman, CEO of 2ONE Labs, said,
"This ruling is very important because it prohibits Imperial Tobacco from continuing to sell ZONE nicotine pouches in the United States until the current 2ONE trademark litigation is resolved."
According to the judge's ruling, "the defendant (Imperial) may not sell oral nicotine products using the Bullseye trademark or any similar mark." (Case No.: CV 24-08124-MWF (Ex) Title: 2ONE Labs Inc. et al. v. ITG Brands, LLC et al.)
"We are very pleased that the court made the right decision and granted this PI. This is an extraordinary remedy for 2ONE and sets the stage for 2ONE to prevail in its trademark infringement lawsuit against Imperial Tobacco."
