EU member states have some flexibility in transposing TPD3 into domestic law, so nicotine pouches may be regulated differently. It is expected that many countries will wait for the implementation of TPD3 before formulating specific national laws to avoid conflicts with EU laws.

 

Although the European Commission is leaning towards banning nicotine pouches, there is a risk that nicotine pouches will be treated in the same way as tobacco-containing snus and subject to restrictions under TPD3. It is expected that the vast majority of countries will choose regulation rather than ban.

The EU nicotine bag market is huge, with the top five markets being Sweden, Finland, the Czech Republic, Denmark and Germany. However, the most popular brands are different in different markets. Kassinger concluded that although nicotine pouches are an important alternative to traditional tobacco products with better economics and lower selling prices (except in the Czech Republic), they face strong regulatory policy threats. The current reality is that there are many supporters at the civil and expert levels, while EU governments still have a negative attitude at the policy and regulation level, calling for bans or strict control.
