New law in Ukraine takes effect: ban on the sale of flavored tobacco products from July 11

From July 11, 2024, the sale of flavored cigarettes, rolling tobacco, e-cigarettes and their e-liquids will be banned in Ukraine, and the packaging of all tobacco products must carry a health warning. This is a ban implemented in accordance with Ukrainian Law No. 1978-XI and European Directive 2014/40/EU.
From July 11, 2024, flavored cigarettes, rolling tobacco, e-cigarettes and e-liquids will disappear from store shelves, and the packaging of all tobacco products must carry a comprehensive medical warning, Babel.UA reported on July 11.
This is required by Ukrainian Law No. 1978-XI, which was adopted a year ago (July 11, 2023).
The law provided for a year to sell off remaining tobacco and nicotine products, but by July 11, this period had expired, so the ban was fully effective.
The changes were adopted in accordance with the World Health Organization's Framework Convention on Tobacco Control and the European integration Directive 2014/40/EU. The documents state that flavored tobacco products are addictive and the ban is intended to protect people from this harm.
From July 11, 2024, all tobacco products must carry updated health warnings on their packaging, and on 65% of the largest side area of the packaging, manufacturers must display images of diseases caused by smoking and text warnings about the harms and consequences of smoking.
In addition, the packaging should also be accompanied by a QR code with a link to the free smoking cessation service "I Quit!" of the Public Health Center.
According to Order No. 747 of the Ministry of Health of Ukraine, new standards for the labeling of tobacco products came into effect on January 11, 2024, and a total of 14 medical warnings in three groups were developed. These warnings will be updated every year, and the disease images will also be updated.
In addition, according to Articles 10 and 10-1 of Law No. 1978-IX, which came into effect a year ago, flavored cigarettes, cigarette tobacco, e-cigarettes and e-liquids with flavoring additives must be removed from store shelves.
In addition, it also stipulates:
Prohibition of the addition of additives (such as vitamins) to tobacco products and e-cigarettes that may mislead consumers about the consequences of using these products;
Requirements for the composition of e-cigarette oils;
Reporting requirements for manufacturers and distributors of tobacco products and e-cigarettes.
Until July 11, 2024, the law allows the sale of products manufactured or imported before the law comes into force.
Directive 2014/40/EU requires all EU member states to ban flavored heated tobacco products by October 2023. This requirement also applies to Ukraine. The relevant initiative has been submitted to the parliament through the draft law No. 9227.
