China: According to the "Electronic Cigarette Management Measures" implemented in 2022, the sale of flavored e-cigarettes except for tobacco flavors is prohibited. This means that selling menthol-flavored e-cigarette liquid within China is illegal.

The United States: The Food and Drug Administration (FDA) of the United States uses the "comparative efficacy standard" for approval. Non-tobacco-flavored products, such as menthol, need to prove that their effectiveness in helping adults quit smoking is significantly better than tobacco-flavored products before being approved. In practice, the FDA has rejected the majority of applications for the listing of menthol e-cigarettes. As of now, the FDA has only authorized 4 menthol e-cigarette products for listing.
